Prospective Buyer agrees that in the case that Seller cannot cover Broker's fee in the event that Buyer (including its parent, subsidiary or related entities or any entity in which the principal(s) of Buyer are a principal) should ultimately purchase all or any portion of this Property from the Owner (including its parent, subsidiary or related entities or any entity in which the principal(s) of Owner are a principal) as a result of viewing this property on the Land Link website, then Buyer shall pay Broker a sale commission computed in accordance with the following:
As to sales of improved real property, Broker’s commission shall be 3.5% of the gross sales price. As to sales of unimproved real property, defined herein as real property on which no permanent structure has been erected, Broker’s commission shall be 3.5% of the gross sales price. Gross sales price shall include any and all consideration received or receivable in whatever form (including without limitation assumption or release of existing liabilities).
All parties agree to comply with all applicable federal, state, and local laws, including but not limited to the 1964 Civil Rights Act and all amendments, the Foreign Investment in Real Property Tax Act, and Comprehensive Environmental Response Cooperation and Liability Act, and the Americans with Disabilities Act.
